AGREEMENT TO OUR LEGAL TERMS

We are DIGIWEIGH PVT LTD, doing business as Weighing Mart ("Company", "we", "us", or "our"), a company registered in India at:
206-Jain Plaza, Link Road, Bilaspur (C.G.) 495001.

We operate the website https://weighingmart.in/ (the "Site"), the mobile application Weighing Mart (the "App"), as well as any other related products and services that refer or link to these legal terms (collectively, the "Services").

These Legal Terms form a legally binding agreement between you ("you") and DIGIWEIGH PVT LTD regarding your access to and use of the Services. By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms.

 IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, YOU MUST STOP USING THE SERVICES IMMEDIATELY.

We may update these Terms from time to time, and we will notify you of changes via email or through the Services. If you continue using the Services after such updates, it means you accept the revised terms.

The Services are for users at least 13 years old. If you are under 18, you must have permission from a parent or guardian.

 We recommend that you print or save a copy of these Terms for future reference.

1. OUR SERVICES

The information provided in the Services is not intended for distribution or use in any jurisdiction or country where such distribution or use would violate laws or require registration. If you choose to access the Services from other locations, you do so at your own risk and are responsible for compliance with local laws.

2. INTELLECTUAL PROPERTY RIGHTS

Our Intellectual Property

We own or hold licenses for all intellectual property rights in our Services, including source code, databases, software, website designs, audio, video, text, graphics, and trademarks. These elements are protected by copyright, trademark, and other intellectual property laws.

You are granted a non-exclusive, non-transferable, revocable license to:

3. USER REPRESENTATIONS

By using the Services, you confirm that:

2. You will maintain the accuracy of your information and update it as necessary.
3. You have the legal capacity to enter into these Terms and will comply with them.
4. You are at least 13 years old.
5. If you are a minor, you have permission from your parent or guardian.
6. You will not use automated or non-human methods (bots, scripts, etc.) to access the Services.
7. You will not use the Services for any unlawful or unauthorized purpose.
8. Your use of the Services will not violate any applicable law or regulation.

If you provide false or inaccurate information, we have the right to suspend or terminate your account.

4. USER REGISTRATION

To use certain features of the Services, you may need to register an account.

• You must keep your password confidential.
• You are responsible for all activities that occur under your account.
• We reserve the right to remove, reclaim, or change your username if we determine it is inappropriate, obscene, or otherwise objectionable.

5. PRODUCTS

We make every effort to display product details accurately, but we do not guarantee that descriptions, colors, features, and specifications are completely error-free or up-to-date.

• Availability: Products are subject to availability, and we may discontinue any product at any time.
• Pricing: Prices are subject to change without notice.
• Display Differences: Your electronic device may display product colors differently from their actual appearance.

6. PURCHASES AND PAYMENT

By making a purchase, you agree to:

1. Provide current, complete, and accurate payment and account information.
2. Update your payment details (email, payment method, card expiration, etc.) as needed.

5. Acknowledge that all payments are in Indian Rupees (INR) and that prices may change at any time.

We reserve the right to:

• Restrict orders based on customer account, payment method, or shipping address.
• Cancel orders that seem to be placed by resellers or distributors.

7. RETURN POLICY

You must not use the Services for any unlawful or unauthorized purpose. This includes, but is not limited to:

Violating these rules may result in immediate suspension or termination of your account.

9. USER-GENERATED CONTRIBUTIONS

The Services do not currently allow users to submit or post content.

10. CONTRIBUTION LICENSE

If you submit feedback, suggestions, or other information to us, you agree that we may use and share such content without compensation to you.

11. GUIDELINES FOR REVIEWS

If you leave a review on the Services, you must:

• Have firsthand experience with the product or service.
• Avoid offensive, racist, or hateful language.
• Not reference illegal activity or false claims.
• Not be affiliated with a competitor if posting a negative review.
• Not organize campaigns to manipulate reviews.

We reserve the right to accept, reject, or remove reviews at our discretion.

12. MOBILE APPLICATION LICENSE

If you access the Services via our mobile app, we grant you a limited, non-transferable, revocable license to install and use the app on your device.

You must not:

• Decompile, reverse-engineer, or modify the app.
• Remove copyright or trademark notices.
• Use the app for commercial purposes without permission.
• Use the app to send spam or automated messages.

Apple and Android Users

By downloading the app from the Apple App Store or Google Play Store, you acknowledge that:

• The app is subject to the store's terms of service.
• The respective store is not responsible for maintenance or support.
• You are not in a country under a U.S. embargo or designated as a "terrorist-supporting" country.

13. ADVERTISERS

We allow advertisements on our Services, but we do not endorse any third-party advertisers or their content.

14. SERVICES MANAGEMENT

We reserve the right to:

• Monitor for violations of these Terms.
• Restrict or block access to any user.
• Disable excessive or harmful content.
• Manage the Services for optimal performance and security.

15. PRIVACY POLICY

By using our Services, you agree to our Privacy Policy, which governs how we handle your data. If you access the Services from outside India, you agree to transfer your data to India and comply with local laws.

16. TERM AND TERMINATION

These Terms remain in effect while you use the Services. We may:

• Deny access to the Services at any time for any reason.
• Suspend or terminate your account if you violate these Terms.
• Take legal action against violators.

If your account is terminated, you cannot create a new one under a different name.

17. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to:

We are not liable for any loss or inconvenience caused by service interruptions.

19. DISPUTE RESOLUTION

Informal Negotiations

Before filing a dispute, both parties agree to attempt informal resolution for at least 30 days.

Arbitration

If a dispute is not resolved informally, it will be settled by arbitration in Bangalore, India under the rules of the European Arbitration Chamber.

Restrictions

• No class action lawsuits are allowed.
• Intellectual property disputes are not subject to arbitration.

20. CORRECTIONS

We may update the Services to correct errors, inaccuracies, or omissions in descriptions, pricing, availability, and other information without prior notice.

21. DISCLAIMER

The Services are provided "as-is" and "as available" without warranties of any kind. We do not guarantee that:

• The Services will be uninterrupted or error-free.
• Information provided will be accurate or reliable.
• The Services will be free of viruses or harmful components.

We are not responsible for any loss, damage, or security breaches caused by using the Services.

22. LIMITATIONS OF LIABILITY

We will not be liable for:

• Any indirect, consequential, or incidental damages.
• Lost profits, lost revenue, or loss of data.
• Any errors, interruptions, or security breaches in the Services.

Our maximum liability is limited to the lesser of:

• The amount you paid to us in the past six (6) months, OR
• ₹100,000 (One Lakh Rupees).

Some jurisdictions may not allow certain limitations, so these may not apply to you.

23. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from any claims, damages, or legal actions due to:

• Your use of the Services.
• Your violation of these Terms.
• Your infringement of third-party rights.

If we face legal claims due to your actions, you agree to cover our legal expenses.

24. USER DATA

We maintain data related to your use of the Services, but you are responsible for backing up your data. We are not liable for any data loss or corruption.

25. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

By using the Services, you agree to:

• Receive electronic communications (emails, notices, etc.).
• Use electronic signatures and transactions.
• Waive rights requiring physical signatures or paper-based records.

26. SMS TEXT MESSAGING

• You can opt out of SMS messages by replying "STOP".
• Message and data rates may apply.

27. MISCELLANEOUS

• These Terms represent the entire agreement between you and us.
• We are not responsible for external factors causing delays or failures.
• If any part of these Terms is unenforceable, the rest will remain valid.
• No joint venture, partnership, or employment relationship is created between us.
